Claims and disputes on a project do not appear suddenly or even unexpectedly. Experience indicates that when a dispute occurs, there is normally a backstory or history of events—decisions or a lack of decisions—that occurred anywhere from a few weeks to several years prior. Typically, these past events or decisions are identified as the “early warning signs” of claims and disputes. Often, it is only when claims are filed at the end of a project that attorneys and claims consultants review project documentation and interview the project team to identify these early warning signs. Many project team members share a similar thought, “If only I had recognized that when it happened!” A detailed list of early warning signs of pending construction claims and disputes can be an invaluable tool for any project team. Based on the collective observations of a number of construction claims practitioners, the Ankura Construction Forum established a list of these warning signs and divided them into the typical phases of a project including Planning and Bid, Initial Contract, and Construction.
