Envision™ Sustainability Rating System & NYC Projects

Summary: The Institute for Sustainable Infrastructure (ISI) Envision™ tools are being used increasingly to guide project planning and design teams and meeting sustainability principles on infrastructure projects. Evolving Construction Disputes - 2015

Summary: This panel will discuss evolving legal issues that should be of concern to CMs and CMARs. The discussion will probe the recent Massachusetts case holding a CMAR liable for a design issue because of the CMAR’s preconstruction and "design" role, and the potential impact of this holding on the "new methodology" of a CMAR. The panel will also discuss the deteriorating quality of expert-prepared delay claims exacerbated by the “vanishing trial" in the U.S. and the impact of this trend on CMs and CMARs.

How Proactive Partnering Efforts Saved a Faltering Project

Summary: This session will highlight efforts by the NYC-DEP to foster an atmosphere of partnering on the $187 million Phase 2 Upgrade Project at the Jamaica Waste Water Treatment Plant, where multiple work scopes, unforeseen site conditions, vendor delays, numerous design change orders and stringent completion dates created seemingly overwhelming stresses.

Access to work areas, locations of and access to laydown areas, protection of existing plant infrastructure, and limited contractor resources had all contributed to a schedule with minimal float. An array of additional challenges sent the project budget to $343 million and the schedule into freefall. Project team members retreated to their corners and the blame game started. 

NYCDEP launched a project partnering initiative in which all parties, including the owner, were held accountable; this quickly broke down the parties’ stockades and fostered a sense of common purpose.
